Vermont Attorney General: Marijuana Gifting Remains Illegal

MONTPELIER – Vermont Attorney General T.J. Donovan has clarified that the sale of marijuana, even when it is given as a “gift with purchase,” is still illegal, despite the legalization of marijuana possession.

Donovan unveiled the guidance Monday. He clarified that any purchase, even the purchase of another item “with a purported gift of marijuana,” continues to remain illegal. Vermont legalized the possession of one ounce of marijuana July 1 but did not legalize its sale or distribution.

Businesses in the Burlington area had begun “gifting” marijuana with the purchase of a courier service, arguing there was a loophole in the law and that nobody was actually purchasing marijuana.

Last week, groups opposed to the legalization of marijuana called on Donovan to clarify whether this practice was legal.
